01 Who we are and these Terms

all-ears.tv ("we", "us", "our") is operated by Przemysław Skwarczyński, a sole trader registered in Poland and entered in the Central Registration and Information on Economic Activity (CEIDG).

These Terms and Conditions ("Terms") govern your use of the all-ears.tv website and its free features (the "Service"). By using the Service, you accept these Terms. If you do not accept them, do not use the Service.

The Service is intended for users aged 7 and over. Section 5 contains additional rules for children and accounts.

02 What the Service does

all-ears.tv is a language-learning tool for practising English listening comprehension. It plays short, synchronised excerpts from publicly available YouTube videos together with subtitle lines.

The current free version may include:

  • Browse View, available to visitors without an account, for browsing subtitle lines, listening to clips, and revealing text;
  • LAZY mode, a single-line listening exercise with progressively more help, within a selected range of lines and with no daily limit in the current version; and
  • an optional free account, available only to users aged 16 or over, created with an email address and password or a Google Account, for saving basic preferences and progress.

We do not charge for these features. A paid tier, if introduced, will be governed by separate or updated terms that clearly state the price, billing arrangements, cancellation rules, and any consumer information required by law. We will not convert a free account into a paid subscription without your express agreement.

03 Licence to use the Service

Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, and revocable licence to use the Service for your own private, non-commercial language-learning purposes.

Except for that licence, no rights in the Service are transferred to you. In particular, you may not copy, sell, license, republish, or make available in bulk the Service's selection and arrangement of content, synchronisation data, database elements, or other materials that are protected by law.

04 YouTube and third-party content

We do not host, store, or own the videos displayed through the Service. Videos are streamed directly from YouTube through YouTube's embedded player. We store subtitle text, timestamps, and metadata needed to synchronise the learning exercises with the original video.

Your use of embedded YouTube content is also subject to the YouTube Terms of Service. Google's Privacy Policy governs Google's processing of data in connection with YouTube. The embedded player may cause Google to process technical data and use cookies; see our Privacy Policy for more information.

Video content, channel names, and underlying works remain the property of their respective creators and rights holders. We select short excerpts for language-learning purposes, but do not represent or guarantee that a copyright exception applies in every jurisdiction or to every use. Nothing in these Terms grants you a licence to use YouTube content outside the Service or the permissions given by its rights holders and applicable law.

Rights-holder requests

If you are a rights holder and believe that a video listing, clip, subtitle excerpt, or other material on all-ears.tv infringes your rights, email one@thetime.pl with:

  1. identification of the work concerned;
  2. the specific video, line, or page affected;
  3. your contact details; and
  4. a statement of your good-faith belief that the use is unauthorised.

We will review the request and may remove or restrict access to the disputed material while we investigate.

05 Children and content suitability

The Service is designed for users aged 7 and over. We aim not to include profanity or graphic, bloody violence in the material we select. Some material may include animated or otherwise non-graphic violence.

Because videos come from third-party YouTube creators, we cannot guarantee that every item will be suitable for every child. A parent or legal guardian should decide whether a particular video or exercise is appropriate for the child.

Users aged 7 to 15 may use Browse View and LAZY mode without an account. Users under 16 must not create or use an all-ears.tv account, including through Google Sign-In. A parent or legal guardian should decide whether embedded YouTube content and the relevant cookie choices are appropriate for a child.

06 Accounts

You must be at least 16 years old to create or use an account. If you create an account, you must provide accurate information and keep your credentials confidential. You are responsible for activity under your account, unless applicable law provides otherwise.

You may ask us to delete your account at any time by emailing one@thetime.pl. We will delete or anonymise account data, except for data that we must retain under law or reasonably need to establish, exercise, or defend legal claims. Details are in our Privacy Policy.

We may suspend or terminate an account where reasonably necessary to address a material breach of these Terms, security risk, fraud, unlawful activity, or serious interference with the Service. Where appropriate, we will tell you the reason and give you an opportunity to address the issue before termination. We may act immediately where delay would create a security, legal, or material operational risk.

07 Rules for using the Service

You must not:

  • use the Service for an unlawful purpose;
  • use automated means, including bots or scrapers, to access the Service, except where our robots.txt expressly permits it or we have given written permission;
  • attempt to download, redistribute, republish, or extract in bulk videos, subtitle data, or other Service materials;
  • circumvent, disable, or interfere with security, access-control, or rate-limiting measures;
  • interfere with the normal operation of the Service; or
  • misrepresent your identity or impersonate a person or entity.

08 Voice-recording feature

The Service may allow you to record your own voice for pronunciation practice. Such recordings are processed locally in your browser and are not uploaded to or stored on our servers. They are available only for the current session and are lost when you refresh the page or leave it, unless the Service clearly tells you otherwise at the time.

Your device and browser control microphone permissions. You should not record another person without their permission.

09 Privacy and complaints

Our Privacy Policy explains how we process personal data, including account data, saved progress, cookies, and third-party services. It forms an important part of your use of the Service.

To make a complaint about the Service, email one@thetime.pl with the subject line "Complaint" and describe the issue, the affected account or page (if relevant), and the outcome you seek. We will respond without undue delay and, where consumer law sets a response deadline, within that deadline.

We do not undertake in advance to participate in out-of-court consumer dispute resolution. If a consumer complaint is not resolved, we will provide the information required by applicable law about out-of-court dispute resolution on a durable medium.

10 Availability and liability

The Service is provided free of charge and on an "as is" and "as available" basis. In particular, we do not guarantee that a particular video, clip, or subtitle line will remain available; YouTube content can be removed, restricted, or made private at any time by its owners.

We do not guarantee that the Service will be uninterrupted, error-free, secure, complete, accurate, or suitable for a particular learning outcome. Nothing in the Service is educational, legal, medical, or other professional advice.

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential loss arising from use of, or inability to use, the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer-protection rights.

11 Changes to the Service and these Terms

We may change the Service or these Terms where reasonably necessary because of legal or regulatory requirements, security, prevention of abuse, changes required by YouTube or other suppliers, technical changes, or product development.

For material changes, we will give reasonable advance notice by posting the updated Terms on the website and, for registered users where practicable, by email or an in-service notice. The notice will explain the change and when it takes effect. You may stop using the Service and request deletion of your account before the change takes effect.

If a change materially and negatively affects a consumer's access to or use of an ongoing digital service, we will provide the notice and any termination right required by applicable law. This does not prevent us from making urgent changes needed for security, legal compliance, or to prevent abuse.

12 Governing law

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles. This choice does not deprive an EU consumer of mandatory protections under the law of their country of habitual residence where those protections apply.

If any provision of these Terms is found invalid or unenforceable, the rest of the Terms will remain in effect.
